Terms of Use (EULA)

These Terms of Use are the End User License Agreement (“EULA”) for Ember. They are a legal agreement between you and Abuzar Munir (“we”, “us”, “our”), the developer of the Ember app for iPhone and Android (“Ember”, “the app”).

By downloading or using Ember, you agree to these Terms. If you don’t agree to them, please don’t use the app.

01The agreement

This agreement is between you and us only. It is not with Apple or Google, and neither is responsible for Ember or its contents.

These Terms apply together with our Privacy Policy, and with the terms of the store you downloaded Ember from: the Apple Media Services Terms and Conditions or the Google Play Terms of Service.

02Licence

We grant you a personal, non-transferable, non-exclusive, revocable licence to use Ember on any device that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions or by the Google Play Terms of Service.

You may not sell, rent, lease, redistribute, sublicense or modify the app, or attempt to derive its source code, except where such a restriction is prohibited by applicable law.

03A free app, supported by ads

Ember is free to download, and every feature is free to use. The free version is supported by ads from Google AdMob, shown at natural breaks such as after a session ends, and never during one. You can watch an optional rewarded video for a period without ads.

We may add, change or remove features as the app evolves.

04Ember Pro subscriptions

Ember Pro is optional and removes the ads. It is offered as an auto-renewable subscription, billed weekly, monthly or yearly. The price and length of each plan, and any free trial, are shown in the app in your local currency before you buy, and the store confirms the exact amount.

Payment and renewal

  • Payment is charged to your Apple Account or Google Play account when you confirm the purchase.
  • A subscription renews automatically unless auto-renew is turned off at least 24 hours before the end of the current period.
  • Your account is charged for renewal within 24 hours before the end of the current period, at the price of the plan you chose.

Free trials

If a plan includes a free trial, it converts to a paid subscription when the trial ends unless you cancel at least 24 hours before then. Any unused part of a free trial is forfeited when you buy a subscription.

Managing and cancelling

You can manage or cancel a subscription at any time. On iPhone, go to iOS Settings › [your name] › Subscriptions. On Android, go to Google Play › Payments & subscriptions › Subscriptions. In Ember, Settings › Manage Subscription takes you there. Cancelling stops the next renewal; it doesn’t shorten or refund the period you’re already in.

Refunds

All payments are handled by Apple or Google, not by us, so we can’t process refunds. Request an App Store refund at reportaproblem.apple.com, or a Google Play refund through your Google Play order history. Refunds are decided under Apple’s or Google’s policies.

Restoring purchases

If you reinstall Ember or change phones, use Restore on the Ember Pro screen to restore an active subscription bought with the same Apple Account or Google account.

05Your content and data

The tasks, sessions, activities, goals and notes you create are stored on your device. You’re responsible for keeping your own backups: removing the app or losing the device can erase this data permanently, and we have no copy to restore.

How information is handled is explained in the Privacy Policy.

06Acceptable use

Use Ember lawfully. Don’t use it in any way that breaks applicable law, interferes with the app’s operation, or attempts to gain unauthorised access to any system.

  • Ember is a planner, a timer and a record of the time you choose to log. It is not a medical device and doesn’t provide medical, psychological or health advice.
  • Timers, alerts and reminders can be delayed or silenced by your device’s settings, battery saving or Do Not Disturb. Don’t rely on Ember for anything safety-critical or time-critical.

07Third-party services

Ember relies on services from other companies, including the App Store, Google Play, Google AdMob, Firebase and Adapty. You must comply with any third-party terms that apply when you use Ember. We don’t control the ads shown by AdMob or the websites they link to, and we aren’t responsible for their content.

08Maintenance and support

We are solely responsible for providing any maintenance and support for Ember. Apple and Google have no obligation whatsoever to furnish any maintenance or support services for the app.

09Warranty

To the maximum extent permitted by applicable law, Ember is provided “as is” and “as available”, without warranty of any kind. We don’t guarantee that it will always be available, uninterrupted or free of errors.

For copies downloaded from the App Store: in the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app (if any) to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to Ember. Any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to any warranty are our sole responsibility.

Nothing in these Terms removes statutory rights you have as a consumer that can’t be excluded or limited by law.

10Limitation of liability

To the extent permitted by applicable law, we are not liable for indirect, incidental or consequential loss arising from your use of, or inability to use, Ember, including lost data or lost time records.

11Product claims

We, not Apple, are responsible for addressing any claims from you or any third party relating to Ember or your possession and use of it, including: (i) product liability claims; (ii) any claim that Ember fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy or similar legislation.

12Intellectual property

Ember, including its name, design, clock faces, artwork and code, is owned by us and protected by copyright and other laws. These Terms give you a licence to use the app, not ownership of it.

In the event of any third-party claim that Ember or your possession and use of it infringes that third party’s intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of that claim.

13Legal compliance

You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

14Apple as third-party beneficiary

For copies downloaded from the App Store, Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple has the right, and is deemed to have accepted the right, to enforce these Terms against you as a third-party beneficiary.

15Termination

These Terms remain in effect until terminated by you or by us. Your rights under them end automatically if you fail to comply with any of their provisions. You may end them at any time by deleting the app from your devices. Deleting the app doesn’t cancel a subscription; cancel it in your store account as described above.

16Changes to these Terms

We may update these Terms as the app evolves. When we do, the date at the top of this page changes, and the current version is always available at ember.app/terms. Continuing to use Ember after an update means you accept the revised Terms.

17Governing law

These Terms are governed by the laws of the United States, excluding its conflict-of-laws rules, except where local consumer law grants you rights that can’t be overridden by agreement.
